For a mortgage payoff when you sell in Crown Point, the number that matters is the payoff statement, not the balance on your monthly bill. Under federal Regulation Z, your servicer must send an accurate payoff statement within a reasonable time, and no more than seven business days after a written request. At our Crown Point shop we gather your loan details at listing, so the payoff is ordered early and your net sheet uses real numbers.

Your payoff amount and your balance
The CFPB answer on payoff amounts says your payoff amount is what it takes to satisfy the loan and pay off the debt completely. It is different from your current balance.
The CFPB says the payoff includes interest due through the day you plan to pay off the loan. It may also include fees you were charged and have not paid. If you pay off early, it may include a prepayment penalty.
So the balance on your monthly statement is only our first pass at your net sheet. We swap in the payoff figure once it arrives.
The seven business day rule
Federal rule 12 CFR 1026.36(c)(3) covers loans secured by a dwelling. The creditor, assignee, or servicer must send an accurate statement of the full amount needed to pay the loan as of a specified date.
The statement is due within a reasonable time, and no more than seven business days after a written request from you or someone acting for you. For a loan in bankruptcy or foreclosure, a reverse or shared appreciation mortgage, or a natural disaster or similar event, the rule only requires a reasonable time.
The CFPB official interpretation says the servicer may set reasonable rules for payoff requests, such as a mailing address, email, or fax number. It may also verify who is asking and get your authorization before the clock starts. So sign the authorization fast when it comes.
A home equity line too. The rule says the payoff statement requirement also covers a home equity line of credit secured by a dwelling. Tell us about every loan on the home.

Prepayment penalties
The CFPB answer on prepayment penalties says it is a fee some lenders charge if you pay off all or part of a mortgage early, and that you would have agreed to it at your closing. Not all mortgages have one.
The CFPB says that typically, a prepayment penalty only applies if you pay off the whole balance within a set number of years, usually three or five, for example because you sold your home.
To find it, check the CFPB answer on paying off early says a penalty must have been disclosed in your loan documents. Sometimes it is only in a page called the Addendum to the Note. Read the Note and anything titled Addendum before we set a price.
Your escrow refund
If your taxes and insurance run through an escrow account, 12 CFR 1024.34(b) says the servicer must return what is left in the account it controls within 20 days of the payoff, not counting Saturdays, Sundays, and legal public holidays.
The rule lets the servicer move the money to an escrow account on a new loan instead, but only if you agree and the new loan has a tie to the old one, such as the same lender or the same servicer. Buying your next home with the same lender? Ask about that before closing.
How Indiana clears the mortgage
Under Indiana Code 32-28-1-1, once the debt and interest are fully paid, the holder must release, discharge, and satisfy the mortgage of record.
Indiana Code 32-28-1-2 covers a holder that does not. Say you send a written demand by registered or certified mail, return receipt requested. If the holder has not released the mortgage of record within 15 days after it gets the demand, it forfeits up to $500 plus costs and reasonable attorney’s fees.
Under Indiana Code 32-29-6-9, if no release is recorded within 60 days after the payoff was sent under a payoff statement, a title insurance company may record a certificate of release. It has to send written notice to the lender or servicer at least 30 days before it signs the certificate. Indiana Code 32-29-6-10 says the certificate must state that the mortgage had an original principal of not more than $1,000,000.
How we prepare a seller for the payoff
1. List every loan. At listing we ask for your latest mortgage statement and any home equity line, with the lender names and loan numbers.
2. Check for a penalty. Pull the Note and any Addendum to the Note. If a penalty is there, it goes on the net sheet.
3. Run the net sheet. It puts the price, selling costs, and estimated payoff on one page. Use our seller net sheet answer. Then read Listing Agreements With Our Crown Point Shop.
4. Sign the payoff authorization fast. Once a buyer signs, a payoff as of the closing date is requested from your servicer. Your servicer may want your signed OK first.
5. Keep paying until closing. Keep making your monthly payments until the sale closes and the payoff is sent.
6. Watch for the escrow check and the release. Look for the escrow refund within the 20-day window. Then check that the release shows up in the county record. Call us if it does not.

Nichols House, built in 1902, on West Commercial Avenue in Lowell.

The tradeoffs to weigh
Pay down the loan or keep the cash. Extra principal lowers the payoff. It also ties up cash you may want for the move. Look at both on the net sheet.
Sell now or after a penalty window ends. If your Note has a penalty that ends on a set date, waiting can save that fee. It also means carrying the home longer. Read our price reductions guide and seller concessions guide.

Questions about mortgage payoff when you sell in Crown Point
How long does it take to get a mortgage payoff statement?
Federal Regulation Z says your servicer must send an accurate payoff statement within a reasonable time, and no more than seven business days after a written request, with exceptions such as a loan in bankruptcy or foreclosure. Call us at (219) 801-0432. We are licensed in Indiana and Illinois.
Is my mortgage payoff amount the same as my loan balance?
No. The CFPB says your payoff amount includes interest due through the day you pay off the loan and may include fees you were charged and have not paid yet. Your monthly statement balance may not show that.
Will I pay a prepayment penalty when I sell my house?
Only if your loan has one. The CFPB says not all mortgages have a prepayment penalty, and that it must have been disclosed in your loan documents, sometimes only in an Addendum to the Note. Check the Note and any addendum before you list.
What happens to my escrow account when I sell?
Federal rule 12 CFR 1024.34 says that within 20 days of paying off the loan, not counting weekends and legal public holidays, your servicer must return what is left in the escrow account it controls.
How does my mortgage get released after I sell in Indiana?
Indiana Code 32-28-1-1 says once the debt is fully paid, the holder must release, discharge, and satisfy the mortgage of record. If no release is recorded within 60 days after the payoff was sent, Indiana Code 32-29-6-9 lets a title insurance company record a certificate of release after 30 days of written notice.
