Assumable Mortgage in Crown Point: What Sellers Should Know

By in Selling with 0 Comments

An assumable mortgage in Crown Point lets a qualified buyer take over your home loan, with its rate and remaining balance, instead of getting a new one. The CFPB says most loans backed by FHA, VA, or USDA can be assumed. The buyer still has to qualify, and still has to cover the gap between the price and what you owe. At our Crown Point shop we ask about your loan type at the listing meeting, so an assumable loan is part of the plan from the start.

How an assumption works

The CFPB post on financing options when rates are higher says that with a loan assumption, the buyer takes over the remaining balance of the seller’s mortgage with the original loan terms. It says that can let a buyer take over a fixed rate far below the current market.

The catch is cash. The CFPB says the buyer needs to make up any difference between the sales price and the balance of the loan. It says finding a lender willing to make a second mortgage for that difference may be challenging, so assumptions may be easier for buyers who can make larger cash down payments.

Not sure what loan you have? Your monthly statement names your servicer. Our mortgage types guide explains FHA, VA, USDA, and conventional loans.

If you have an FHA loan

HUD Handbook 4000.1 says all FHA insured mortgages are assumable. It says the buyer who assumes must be underwritten under FHA rules. For a loan closed on or after December 15, 1989, HUD says the buyer must plan to live in the home as a principal residence or a HUD approved secondary residence.

Get the release. HUD says the lender must prepare form HUD-92210.1, Approval of Purchaser and Release of Seller, when you sell by assumption to a buyer who signs an agreement to assume and pay the debt. HUD’s notice to homeowners says that without a release from liability you are still liable for the mortgage debt, and that once the form is executed you are no longer liable.

Fees. HUD says the lender may charge the buyer who assumes a processing fee that is reasonable and customary.

If you have a VA loan

Who can assume. VA Form 26-10291 says any qualified buyer, including a non-Veteran, may assume your VA loan. The buyer must meet VA’s credit and income standards, and the loan must be current at closing. If the assumption is approved, VA says you will no longer be responsible for the mortgage payment.

Your entitlement. The same form says your VA entitlement stays tied to the loan unless the buyer is an eligible Veteran who substitutes their own entitlement for yours. That buyer must have enough entitlement and must plan to live in the home. VA says your servicer, your lender, or a VA loan specialist can help you figure how much entitlement you would have left.

Timing and fees. VA Circular 26-23-10 says a loan holder or servicer with automatic authority must decide on an assumption within 45 calendar days of a complete application. A denial can be appealed to VA within 30 calendar days by the seller or the buyer. The circular says a funding fee of 0.5 percent of the loan balance must be paid on an assumption and collected at closing, unless the buyer qualifies for a fee waiver.

USDA and conventional loans. The CFPB says most USDA loans can be assumed too. If your loan is conventional, ask your servicer in writing whether it can be assumed before anyone tells a buyer it can.

How our shop handles an assumable loan

1. Loan type at the listing meeting. We ask for your latest mortgage statement so we can see the loan type, the rate, the balance, and the servicer. Read how we handle the mortgage payoff when you sell.

2. You ask the servicer early. We ask you to call your servicer and ask whether the loan can be assumed, what the steps are, and what it charges. The servicer, or VA itself on some VA loans, decides whether the buyer is approved.

3. We say it plainly to buyers. Once your servicer confirms, we tell buyers the loan may be assumable, subject to the servicer approving them. Not before.

4. We size the cash gap. The buyer brings the price minus your balance, unless a second loan covers part of it. We run your seller net sheet both ways so you can compare.

5. A plan if the servicer says no. We talk with you about what happens if the assumption is denied, so the sale has a backup path. Selling and buying at once? Read buying and selling at the same time.

The tradeoffs to weigh

A rate buyers want or a smaller pool. A low rate can draw buyers. The cash gap can also shrink the group who can actually do it.

Speed. A VA assumption decision can take up to 45 calendar days after a complete application. Plan your move date with that in mind.

Your next VA loan. If the buyer does not substitute entitlement, VA says yours stays tied to the loan until it is paid in full. Planning to buy again with a VA loan? Ask your lender first.

Release in writing. On an FHA loan, ask for form HUD-92210.1. On a VA loan, keep the approval that says you are released from the payment.

Questions about an assumable mortgage in Crown Point

Can a buyer take over my mortgage when I sell in Indiana?

Sometimes. The CFPB says most loans backed by FHA, VA, or USDA can be assumed, and HUD says all FHA insured mortgages are assumable. The buyer still has to qualify with your servicer. Call Pam at (219) 801-0432 or Sash at (219) 808-1520 and we’ll look at your loan with you.

Am I still liable after a buyer assumes my FHA loan?

Not if you get a release. HUD’s notice to homeowners says you are still liable for the mortgage debt unless you get a release from liability, and that form HUD-92210.1, Approval of Purchaser and Release of Seller, is that release. Ask for it in writing.

What happens to my VA entitlement if a buyer assumes my VA loan?

VA Form 26-10291 says your entitlement stays tied to the loan unless the buyer is an eligible Veteran who substitutes their own entitlement for yours. Without that, it is not restored until the loan is paid in full.

Does the buyer pay me the difference between the price and my loan balance?

The CFPB says the buyer needs to make up any difference between the sales price and the balance of the assumed loan. It says a second mortgage for that gap may be hard to find, so assumptions may be easier for buyers with larger cash down payments.

How long does a VA loan assumption take?

VA Circular 26-23-10 says a loan holder or servicer with automatic authority must decide within 45 calendar days of a complete application. A denial can be appealed to VA within 30 calendar days by the seller or the buyer.
